Beauty Salon Barber Shop Contract

Agreement made this DATE, between NAME who resides at the Beauty and Barber Shop at Sequoia Springs Senior Living, CA, 95540. Both parties agree as follows.

• Sequoia Springs Senior Living will supply at its own cost the beauty parlor/barber shop space and the existing equipment, which consists of sinks, chairs, mirrors, barber chairs, cabinets, air conditioning, heat and light. Sequoia Springs Senior Living shall refer any resident who might need barber and/or beauty services to CONTRACTOR exclusively. Both parties acknowledge that residents have the freedom to choose any beauty parlor/barber shop to provide the service noted below.
• CONTRACTOR agrees that they are an independent contractor and not an employee of Sequoia Springs Senior Living. CONTRACTOR will provide Sequoia Springs Senior Living with a copy of their valid beautician’s license. She/he will provide her/his expertise as a beautician/barber and all supplies having to do with its hairnets, etc. at their own expense.
• Rent will be due in the amount of $200/month by the tenth of the month.
• Contractor will provide $500,000 of liability insurance associated with the labor and services she is providing at the facility, and will provide the facility with a valid Certificate of Insurance evidencing same, and naming the facility as an additional insured.
• Contractor shall contract directly with residents in the facility, and shall be paid on a fee for service basis by said residents at rates published and approved by facility. It is not permissible for CONTRACTOR to see clients outside of Sequoia Springs Senior Living residents in this location.
• The Beauty/Barber Shop will be operated primarily for the convenience and availability of the residents of the. Sequoia Springs Senior Living As such, it must be operated _______ days a week on the following days; ___________________________________ in a manner acceptable to the Director and the residents.
• Contractor will refrain from becoming involved in any problems or issues of facility except those that affect her/his provision of services.
• Contractor will maintain shop in clean and orderly manner in keeping with licensing requirements of both the facility and the beauty shop or beautician.
• Contractor may hire additional employees if she/he deems it necessary to service the residents of the facility. Said employees will be employed by the Contractor at her/his own expense, and she/he will provide all appropriate insurance of said employees, including Worker’s Compensation. Notwithstanding the above, it is agreed that the beautician/barber services provided by others who do not, in the facility’s sole opinion, provide the quality, skill and personality of contractor, will give the facility the right to ask contractor to terminate said employee. If she/he fails to terminate said employee as requested within three (3) days, facility may terminate this Agreement on seven (7) days notice.
• This contract shall be in effect for one for one year commencing on ________and terminating on_______. This Agreement can be terminated by either party by giving fifteen (15) days written notice to the other. Contractor shall not sell assign, sublet or transfer her/his rights in and to this Agreement with facility at any time, and this Agreement may not be mortgaged, collateralized or pledged by contractor at any time for any purpose. This Agreement is and shall remain subordinate to any management Agreement, mortgage or financing now or hereafter affecting the facility.
