Under the supervision of the Senior Vice President of Mission Integration, the Associate Vice President, EO & TIXC will serve as the Chief Civil Rights Officer, Director of the Office of Title IX and Equal Opportunity (OTIXEO) Compliance Initiatives, and Title IX Coordinator. This position is responsible for coordinating and directing functions for WesternU’s compliance efforts with obligations under various civil rights legal frameworks, Pay Equity requirements, and Equal Opportunity and Nondiscrimination legal frameworks, such as, Title VI & Title VII of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990, and Age Discrimination Act of 1975. This responsibility includes enforcement of these requirements for students, employees, and third parties. As Director of OTIXEO Compliance Initiatives, oversees complaint resolution and educational programs to prevent and eliminate protected class discrimination, harassment, and retaliation (DHR), prevent its recurrence and remedy its effects. This oversight includes establishing goals, policies, and best practices for OTIXEO Compliance Initiatives. Represents the Office of Mission Integration and supports the achievement of the Office’s functions and goals.

- Ability to stay current with laws, rules, and regulations related to civil rights enforcement and compliance administration;
- Demonstrated ability to handle, manage, and secure confidential and private information;
- Advanced understanding of and sensitivity to meeting the needs of the diverse academic, socioeconomic, cultural, disability status, caste, gender identity, sexual orientation and ethnic identities of the WesternU student, community, and employee populations.
- Ability to strategically design system of equal opportunity, Title IX, and civil rights compliance monitoring, technology, trend forecasting, and stakeholder collaboration.
- Knowledge of:
1. Applicable sections of civil rights and violence prevention laws, including: California Fair Housing and Employment Act, Clery Act, Violence Against Women Act, Campus SaVE Act, Americans with Disabilities Act, and the Child Abuse and Neglect Reporting Act (CANRA).
2. Methods and techniques of trauma-informed investigations and adjudications pursuant to California and other legal requirements.
3. Proven practices and strategies for investigation, negotiation, alternative dispute resolution, mediation, and arbitration.
4. Strategies identifying and building cross-functional partnerships to understand challenges.
5. Intersectional diversity, inclusion, belonging, equity, antiracism, and equal opportunity.
Required Qualifications
Experience
- 5 years or more of experience in civil rights compliance program management
- 5 years or more of experience conducting/managing protected class investigations (from intake to resolution)
- Sensitivity to and understanding of the diverse educational, socioeconomic, cultural, ability, racial, and ethnic identities of students and employees in an academic setting.
Education
Bachelor’s degree from an accredited college or university with relevant coursework in political science, social work, human resources, public policy human resources, business administration or equivalent experience.
Applicable coursework and/or training or certification in federal and state civil rights laws and regulations in higher education context.
A combination of experience/skills and education to fulfill the requisite knowledge, skills and abilities for this position may be considered.
Preferred Qualifications
- Four (4) years or more of related experience with trauma-informed approaches to complaint resolution
- Five (5) years or more of enforcement of Discrimination, Harassment, Retaliation complaints or Title IX/VAWA/Clery Act implementation experience in the higher education context;
- Advanced Degree (such as a Master’s degree or higher in relevant field of study or Juris Doctorate (J.D.) from an accredited college or university) with relevant coursework in social work, human services, human resources, public policy or related field

- Implement strategy for responding to and managing all reports and complaints of protected class discrimination from students, employees, and third-parties of policy violations and unlawful discrimination, harassment, and retaliation, including sex and gender discrimination, sexual harassment and sexual misconduct and related laws and regulation (Title VI, Title VII, Title IX, Violence Against Women Act (VAWA), Campus Sexual Violence Elimination Act, and Clery Act) in alignment and collaboration with Legal Affairs;
- Serves as a subject matter expert for and convey recommendations directly to senior leadership regarding civil rights, Equal Opportunity and Title IX Compliance Initiatives (related laws and regulations for various state, federal, and local requirements) in alignment with other compliance/risk management functions and Legal Affairs;
- Coaches and engages campus stakeholders through preventative and responsive consultation to support civil rights compliance
- In collaboration with Human Resources, Student Affairs, and Academic Affairs, establish and maintain policies and procedures for protected class complaint resolution and prevention education;
- Partner with campus stakeholders, including senior leadership, and present reports to other audiences as requested;
- Establish protocols for addressing external and internal inquiries regarding civil rights and equal opportunity laws and regulations
- Assists in replying to inquiries from government agencies (e.g. EEOC, OCR, EDD, FEHA, etc.). and other external institutions in compliance with regulatory requirements;

- Manage the University’s institutional compliance program (complaint resolution and prevention education) related to sex discrimination, sexual and gender-based harassment, interpersonal violence, and other sexual misconduct, the program’s goals and objectives, and establish measurable elements to monitor effectiveness of the compliance program
- Oversees development and delivery of compliance training and education programs for Title IX prevention, awareness, and response, program, AB 1825 sexual harassment prevention, unlawful discrimination, harassment, and retaliation, and related topics.
- Supervises recruitment, training and management of investigators, adjudicators, advisors for all Title IX and non-Title IX Prohibited Conduct cases.
- Ensures the maintenance of the Title IX website to publicize campus and community resources, policies, and procedures.
- Assesses and takes action to mitigate any potential safety risks related to sexual and gender-based harassment and sexual and interpersonal violence.
- Collaborates with University personnel to fulfill the objectives of Clery Compliance and ensure consistent compliance with Annual Security Report drafting and dissemination.
- Supervises the evaluation, enhancement, and coordination of existing University Policies, Employee Handbooks and related policies/procedures for Title IX (and related mandates) Compliance.
- Presents information to educate students, faculty, and staff on the University’s policies and procedures on anti-harassment and discrimination.
- Coordinates policies pertaining to Title IX and other civil rights policies.
- Assists in record-keeping procedures, compliance reviews, audits, and reporting procedures pertaining to all facets of University Title IX and other civil rights compliance efforts.
- Assists in the development, integration, and monitoring of programs and initiatives that support compliance with Title IX, Clery, Campus SaVE and Violence against Women Acts.
- Assists law enforcement personnel and University security officers in handling reports and complaints of sexual assault and related misconduct.
- Serves as subject matter expert for threat assessments related to known acute, imminent, or possible threats of sexual violence.
- Stay abreast of current developments in the field of investigations and changes to applicable regulations (such as Title VI, Title VII, Title IX, and Clery Act).

- Ensures composition of compliance reports and recommendations for appropriate remedies according to mandatory deadlines.
- Prepares, in collaboration with various stakeholders, required annual statistical reports to state and federal agencies, Senior Administration Leadership (SAL), Board of Trustees, and others in the University community on incidences of sexual offenses and claims of discrimination, harassment, and retaliation.
- Oversees the development of communication plans and generation of templates and other communication materials (letters, memos, announcements resource guides, flyers, handouts) to aid in understanding of University policies and procedures.
- Supervises the deployment of a variety of compliance training programs, such as the Drug and Alcohol Prevention Program, Clery Act/Campus Security Authority Training (CSA), Responsible Employee, and Workplace Harassment prevention.
- Supervise staff, including prioritization of work, conducting performance evaluations and providing training.
